While we think we “own” the land, remember that it was here long before us, and will be here long after we’re gone. Trees typically live a very long time, and depending on where you live, there may be legal issues regarding how “your” trees can be treated, cut and/or removed. Some tree work requires permits.
Municipalities can get complicated with rules and regulations. And then there are neighbors who may or may not want branches trimmed and/or trees removed from a property near theirs.
Did you know some lawyers practice “tree law?” It’s a niche market for sure, but it does exist. Governments have a way of enacting civil codes and local ordinances which say what can and cannot be done with regards to local trees. After all, a community has a vested interest in trees—even the ones on your property.
Some legal issues that might involve tree law include dealing with tree hazards and personal injury cases. What if a limb from your property’s tree falls on someone walking or driving by and kills them? Or, for example, what happens if a storm comes and knocks your tree down on to your neighbor’s yard. Are you both responsible for having it removed? People go to court over this! Then there are cases dealing with utility companies, who may or may not properly maintain the space around their wires with regard to tree branches.
